Zoning is defined as the partitioning of a City, Borough, or Township by ordinance into sections reserved for different uses or purposes, that could be as residences, businesses or other. It is the segregation of uses that are thought to be incompatible to ensure that the “character” of a community is preserved. The Zoning Ordinance also contains provisions for Special Exceptions which are permitted uses with reasonable conditions and safeguards, and Variances upon proof of hardship, both of which are administered by the Zoning Hearing Board. The Cheltenham Township Zoning Code is divided into several zones by Ordinance, with specific requirements related to uses, lot area and lot width, building area, yard regulations, building height, buffer zones, green areas, signage and parking, Historic districts, Floodplain Conservation districts, among others. The Pennsylvania Uniform Construction Code, contained in 34 Pa. Code, Chapters 401-405, as amended from time to time, was adopted by the Cheltenham Township and incorporated by reference as the building code of Cheltenham Township except as to those provisions which shall remain in full force and effect, as more specifically set forth in §§ 110-5 and 110-6 or elsewhere in the chapter. Cheltenham Township also elected to administer and enforce the provisions of the Pennsylvania Construction Code Act, further identified as Act 45 of 1999, 35 P.S. §§ 7210.101-7210.1103, as amended from time to time, and its regulations. SUBDIVISION AND LAND DEVELOPMENT
Whether you are planning to subdivide your property (divide a property into separate parcels or consolidate multiple parcels into one), build one or two houses or an entire housing development, a new commercial building or a shopping center, your plans are required to go through a series of reviews to ensure that they are consistent with local and state laws. This is all part of the Subdivision and Land Development Process. In order to promote the public health, safety, and welfare within the Tookany/Tacony-Frankford Watershed by maintaining the natural hydrologic regime and by minimizing the harms and maximizing the benefits of the watershed, all improvements or developments in Cheltenham Township involving 250 square feet of disturbance or more are required to go through a Stormwater Management process.
